About these Terms
These Terms of Use (“Terms”) govern your use of the NŌVAP website and related brand communications (the “Site”). “NŌVAP,” “we,” “us” and “our” refer to the company that operates the NŌVAP brand. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
NŌVAP is not a medical provider
NŌVAP is a women’s health brand. NŌVAP does not practice medicine, nursing or pharmacy, and does not provide medical advice, diagnosis or treatment.
Medical services offered through NŌVAP are provided by independent, licensed healthcare professionals through our telehealth partner and its affiliated professional entities (“Providers”). Providers exercise their own independent clinical judgment. A Provider decides whether any treatment, test or prescription is appropriate for you, and may decide that none is. Prescriptions are filled by licensed pharmacies.
Content on the Site, including articles, protocol descriptions and testimonials, is general information. It is not a substitute for advice from a qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of something you read on the Site. If you think you have a medical emergency, call 911.
Telehealth services and the care platform
When you click “Start your visit” or a similar button, you are taken to a separate, secure care platform operated by our telehealth partner. Your intake, consultations, prescriptions, payments and medical records are handled on that platform and are governed by its own terms of service, telehealth consent and Notice of Privacy Practices, which you will be asked to review and accept there.
Telehealth involves the delivery of healthcare services using electronic communications, including asynchronous (message-based) review and, where required by your state or requested, live video visits. Telehealth has potential benefits and risks, including that a Provider may determine telehealth is not appropriate for your needs and recommend in-person care. Services are available only in states where they are offered, and availability may change.
Eligibility
You must be at least 18 years old and located in the United States to use the Site and request services. Certain treatments have additional eligibility requirements, such as age limits or health criteria, which a Provider will assess. Providing false or incomplete health information may put your health at risk and may result in services being declined or discontinued.
Compounded medications
Many NŌVAP protocols are compounded medications. Compounded medications are prepared by licensed pharmacies for individual patients. They are not approved by the U.S. Food and Drug Administration (FDA), and the FDA does not verify their safety, effectiveness or quality. Compounded medications are not the same as brand-name FDA-approved products. Availability of compounded medications may change because of regulatory or supply changes. Pricing, payments and subscriptions
Prices shown on the Site are the patient prices in effect at the time of posting. Your exact price, billing cadence and what is included are shown on the care platform before you pay, and that information controls. NŌVAP does not bill insurance.
Some plans renew automatically every 4, 12, 24 or 52 weeks until cancelled. Before you are charged, the care platform will clearly show the price, the renewal frequency and how to cancel, and will ask for your consent. You can cancel future renewals at any time through the care platform or by emailing support. Cancellation stops future charges; medication already prescribed, dispensed or shipped generally cannot be returned or refunded because of pharmacy and safety rules. Any refund rights are described on the care platform at checkout.
Prices may change. We will give notice of price changes for renewing plans before they take effect.
Health content and testimonials
Articles and educational content are written by the NŌVAP team for general information and reflect publicly available sources at the time of writing. Testimonials on the Site are illustrative of common experiences and do not guarantee any result. Individual results vary.
Acceptable use
You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or related systems; interfere with the Site’s operation; scrape or harvest data; impersonate any person; or use the Site to obtain medication for someone else.
Intellectual property
The Site and its content, including the NŌVAP name, logo, protocol names, 3D product renders, text, design and software, are owned by or licensed to NŌVAP and are protected by intellectual property laws. You may view and print content for personal, non-commercial use. You may not copy, modify, distribute or create derivative works without our written permission. Product images are illustrative renders, and actual packaging may differ.
Third-party services and links
The Site links to third-party services, including the care platform, pharmacies and laboratories. We are not responsible for third-party content, services or practices, which are governed by their own terms and privacy policies.
Disclaimers
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. NŌVAP does not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any content is complete or current. NŌVAP does not guarantee any health outcome.
Limitation of liability
To the fullest extent permitted by law, NŌVAP and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from or related to your use of the Site. NŌVAP’s total liability for any claim relating to the Site will not exceed the greater of (a) the amounts you paid to NŌVAP in the 12 months before the claim or (b) $100. NŌVAP is not responsible for the medical services provided by independent Providers. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify and hold harmless NŌVAP from claims arising out of your misuse of the Site or your violation of these Terms, to the extent permitted by law.
Dispute resolution
Informal resolution first. Before filing a claim, please email legal@getnovap.com with a description of the dispute so we can try to resolve it informally within 60 days.
Arbitration. If we cannot resolve a dispute informally, you and NŌVAP agree that any dispute arising out of or relating to the Site or these Terms will be resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. The Federal Arbitration Act governs this provision.
Class action waiver. Disputes will be resolved only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding.
Opt-out. You may opt out of this arbitration agreement by emailing legal@getnovap.com within 30 days of first accepting these Terms, with your name and a clear statement that you opt out.
This section does not apply to claims about medical care provided by Providers, which are governed by the care platform’s terms and applicable law.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where the law of your state of residence requires otherwise.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, provide additional notice. Continued use of the Site after changes take effect means you accept the updated Terms.
